Terms and Conditions
Deposit - Family / Glamour photography
A $250 non-refundable deposit is required to secure your session in my calendar. $100 will be credited against any keepsake collection or wall collection purchased at your design consultation appointment.
If you have received or purchased a gift certificate or gift voucher, the $250 deposit is not required to secure your session in my calendar.
If you are booking corporate photography services, full payment is required at the time of booking.
Promotions
If any promotions arise where we are offering a discounted rate, this shall not apply to current booked sessions, or sessions that have been prepaid. Offers may not be used in conjunction with other offers. Offers are not redeemable for cash or products.
Gift Certificates /vouchers/ Special offers
Gift certificates / vouchers/ special offers are non-refundable, are transferable but not refundable for cash. They can not be used in conjunction with any other offer. Only one gift certificate can be redeemed for one session time only. After the photography session a design consultation time will be made available to, at this appointment all decision makers must be present. Appointments are limited and are subject to availability. Gift certificates must be presented when booking in. Lost or stolen gift certificates cannot be replaced or reissued. Only one gift certificate / voucher can be used per session.
For multiple family members/friends/work colleagues etc wishing to gift a voucher please contact Gina. Alternatively if you know everyone wishing to gift a voucher we can combine all amounts into one along with everyone’s details.
This gift certificate can be used for new photography sessions with the studio and cannot be used to purchase from previous sessions.
Gift voucher / Special offers credit applies to keepsake collections and wall art collections only.
Maximum of 5 people including children can be included when using the gift certificates / vouchers/ special offers
Gift certificates expire 18 months from date of issue.
Rescheduling
Your session can be rescheduled in an emergency and is up to the discretion of Embellish Photography.
On-Location sessions may be subject to rescheduling at short notice due to inclement weather conditions, or on rare occasions if the Gina is called away to photograph a birth. Gina will always contact you as soon as possible if this is necessary, to arrange an alternative time.
If you have a sick child on the day of the session please call to reschedule. If you try to keep the appointment, we will most likely request that you reschedule if we notice your child is sick. Sick or uncomfortable children do not like to be photographed and we know that you will not love your portraits nearly as much as if he or she was in good health.
The deposit is not refundable for any reason.
Studio Attendance
Attendance at your photo session is limited to those individuals being photographed. In the case of children and newborns, attendance is limited to 2 parents only (if more parents or grandparents are wishing to attend please discuss this with Embellish Photography). Siblings are welcome if they are to be photographed as well. In order to minimise distractions and ensure a more productive and successful session it is recommended that the number of persons present be kept to an absolute minimum.
Please note that during COVID the studio cannot have more than 8 people.
Release
Embellish Photography has the unrestricted right and permission to use, re-use, publish and republish photographic portraits, videos or pictures of me / my family members, whether it may be included intact or in part, composite or distorted in character or form, without restrictions as to change or transform in conjunction with my own or a fictitious name, or reproduction hereof in colour or otherwise, made through any and all media now or hereafter known for illustration, art, promotion, trade, advertising, or any other purpose whatsoever.
I also permit the use of any printed material in connection therewith, as well as behind the scenes footage of photos or videos posted on social media and relinquish any right to examine or approve the completed product or products or the advertising copy or printed matted that may be used in conjunction therewith or the use to which it may be applied.
Digital Devices
To avoid disruption during the photographic session and to allow Embellish Photography to fulfil its agreed duty, other photography, videography etc by family/friends during the shoot is not permitted. If you wish to record your session for prosperity reasons, please discuss this with Gina before your session.
Digital Devices are not permitted during the design consultation appointment, and screen shots of the slide presentation is also prohibited.
Photographic Rendering
While many images are captured during your session, you will see only those images selected by Gina, the artist. Each finished image is carefully rendered to ensure maximum artistry and technical perfection. All images are photographed in colour but are available in black / white / sepia.
RAW files will not be provided under any circumstances.
Editing | Design Fee
Images will be fully edited when you see them at your viewing and ordering appointment.
If you require additional re-touching services such as head swapping and changing the colour of clothes etc an additional design fee will be charged,
Custom designed products include one allowable change. You will be provided with a proof via email for approval. Please review it carefully as we are not responsible for errors such as the spelling of names, dates, and quotes after your approval has been made. Changes to designs can only be made one time without incurring additional design fees. There after an additional $50 re design fee will be charged.
Monitor Calibration
Embellish Photography is not responsible in any way for the quality of printed reproductions you arrange elsewhere. Embellish Photography’s monitors are fully calibrated and are matched to the profile of our professional labs. This ensures that our prints match what is on our computer.
Design Consultation | Payment
A design consultation appoinment will be scheduled two weeks after your session. I will contact you and arrange a suitable time to meet at the studio and you will be able to view your gallery. It is at this time where you will view your photos and place your order, so it is imperative that all decision makers attend this appointment.
Payment is required in full at this time and can be made by cash, direct deposit or credit card. Due to the custom nature of each session, once images and products are ordered all sales are final. Payment plans are available through PayRight, minimum 10% deposit and up to 12 months to pay off your order.
Late Orders
If you place an order after your design consultation appointment a 15% surcharge will be applied to your order.
Orders that are placed greater than 7 days after the design consultation appointment will have a $100 archival fee applied to the order.
Pick up of orders
Please allow 4-6 weeks for your print order to be completed. Some orders may take longer. You will be notified by telephone or e-mail when your order is ready for pickup.
Re-orders
Additional orders can be made after the design consultation appointment however a minimum $100 order is required. The current pricing at the time of the order will apply.
Image Archive
All ordered images are archived by Embellish Photography for at least 2 years. Images from your session that are not ordered are archived for 30 days from the date of your session, after this period the images will be purged.
Prices are subject to change without notice
Prices are quarenteed for a period of 30 days following the session date of the portrait session. Items purchased more than 30 days after the date of the session will be priced according to the most recent price guide.
Copyright
It is agreed that Embellish Photography retains the copyright to all images taken at your session. It is illegal, unethical and punishable by law to scan, copy or reproduce these images in any manner or medium unless you have purchased a limited copyright licence from Embellish Photography.
Likewise, you cannot authorise any reproductions of images for commercial use, personal use, for photographic competition or display. Even though the pictures may be of you or your child, Embellish Photography owns the copyright to the images and is the only entity who can crop, alter or modify any image produced at your session.
Originals and digital files remain the property of Embellish Photography. It is agreed that Embellish Photography may use any image from our session for industry competitions and as required for reasonable general promotional material for the studio.
While the digital files are available for purchase, copyright is retained by Embellish Photography and a limited release (for personal use only) is given for the files when they are purchased. A limited release means you are able to use your images for any purpose other than 1) sell them to a 3rd party 2) enter them into competitions 3) use them for commercial purposes.
Images are not to be edited or altered in any way, including application of filters from third-party apps such as Instagram.
Damage
You agree to indemnify the Embellish Photography for the costs of replacement and/or repair necessarily incurred as a result of any damage to equipment, except where the damage is caused by reasonable wear and tear. You will indemnity the Embellish Photography for any replacement equipment purchased at current market prices.
No Liability
You agree to hold harmless, Gina and Embellish Photography, from any dispute in the event you become injured during your session or while in the studio premises or on-location. Gina and Embellish Photography will not be held liable for any injury incurred by you or your family, or any damage to your property during the photo session.
Environmental Conditions
You accept that the quality of any services and products are subject to the surrounding environmental conditions, natural characteristic of a product which cannot be altered by the Embellish Photography (Inherent Qualities) and any abnormal climactic conditions Embellish Photography accepts no liability for any damage to products or failure to provide services, as a result of:
the damaging effects of Inclement Weather; and/or fading or discolouring of products, suffered as a result of Inherent Qualities or the environmental conditions in which you have stored the Products.
Behaviour of the Client (you) and Associated Persons
You accept that the quality of services Embellish Photography provides is subject to the behaviour of yourself and associated persons.
Where Embellish Photography has made reasonable attempts to control the you and any associated persons, Embellish Photography accepts no liability for any loss or damage to products or a failure to provide Services.
Embellish Photography reserves the right to refuse service at anytime.
Prices
You agree that you have received, read and understand the Embellish Photography’s price list which will remain as the price list for your session, even if the Embellish Photography’s prices increase between the booking date and your shoot. It is agreed that you will be offered additional product and prices if they happen to change during this time, but only if they benefit you, the client. The price list does not transfer to subsequent shoots in the years to come.
You agree that ALL interested parties understand Embellish Photography’s price list. This means that all financial decision makers in relation to your session are fully aware of the price list associated with your session.
Failure of Equipment
Embellish Photography will carry out this agreement with due and professional diligence. Elements beyond Embellish Photographys’ control include faulty material, equipment failure, failed hard drives and back ups. Every effort to ensure the safety of your precious images has been taken including off site storage and backups. However in the case of the above the studio shall not be liable for its complete performance of the agreement and liability shall be limited to a refund of any money paid under this agreement which shall be full and final satisfaction of any damage or loss suffered.
Refunds
Refunds are not available
By attending your photography session it is taken that you agree to the above terms and conditions.
